General Terms and Conditions
General information:
The General Terms and Conditions apply to all our contracts and services in the currently valid version. These General Terms and Conditions shall be deemed to have been accepted at the latest when products from our range are ordered.
Contract:
No minimum order quantity. All offers in this store are subject to change. Orders are accepted via our online store. The order will be confirmed in writing by email.
Prices:
All prices include the statutory value added tax.
Terms of payment:
We deliver unlimited against payment PostFinance, Visa & Mastercard, TWINT, Paypal, and POWERPAY (purchase on account up to 500.- CHF) With the order the customer commits himself to payment and acceptance. Any costs arising from non-compliance are to be borne by the customer.
Purchase on account with installment facility (POWERPAY)
MF Group / POWERPAY offers the payment method "purchase on account" as an external payment service provider. With the single invoice, you can simply pay for your online purchase by invoice. If you choose not to pay within the specified time frame, you will receive a monthly invoice with an order overview in the following month.
When the purchase contract is concluded, POWERPAY takes over the invoice claim and processes the corresponding payment modalities. When purchasing on account, you accept POWERPAY's GTC in addition to our GTC. (powerpay.ch/en/agb).
Delivery:
Information on delivery dates and delivery periods is non-binding. Under no circumstances do delays in delivery justify claims for damages or a right to withdraw from the contract. In accordance with the Swiss Code of Obligations, the goods are a debt to be collected. The buyer therefore bears the risk of any loss of goods during delivery or after delivery by the post office. This also applies in the case of partial deliveries. The customer is obliged to check the delivered products for completeness and correctness immediately after delivery and to notify Mizunoshop in writing of any damage, defects and complaints immediately after discovery, at the latest 7 days after delivery. Returns & Exchanges
Returns will only be accepted if the product arrives at our central warehouse in its original condition. You have the right to cancel this contract within fourteen days without giving any reason. The revocation period ends fourteen days after the day on which you or a third party named by you, who is not the carrier, has physically taken possession of the last goods. The return shipment must be made within 14 days of receipt of the goods after the withdrawal period. The return costs shall be borne 100% by the buyer.
Goods that are returned despite a clear definition of the conditions for return & exchange will not be refunded. In this case, a fee of CHF 7 will be charged for the return shipment to the customer to cover the additional postage costs incurred for resending the goods to the customer. The goods will only be resent once the fee of CHF 7 has been paid.
To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. a letter sent by post, fax or e-mail) by post to Mizunoshop, PB Vertriebs GmbH, Haselweg 14, 3380 Wangen an der Aare, Switzerland. by e-mail to support@mizunoshop.ch of your decision to withdraw from this contract. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. Retention of title:
The goods remain the property of Mizunoshop until full payment has been received.
Warranty:
The warranty period is 24 months from receipt of the goods. Further claims of the buyer are excluded, regardless of the legal grounds. The customer shall bear the costs for return shipments.
Place of jurisdiction:
All obligations are subject to Swiss law. The place of performance and exclusive place of jurisdiction is BL Liestal.
Final provisions:
Verbal agreements are only binding if they are confirmed in writing by Mizunoshop. Should individual provisions of these GTC be or become invalid, this shall not affect the legal validity of the remaining provisions.
